Supreme Administrative Court stalls due to lack of funding

<P>Until Nov. 12, SAC sent and received its mail on credit. However, the creditor, the state-run UkrPoshta company has refused to provide the service because of SAC’s growing debt which stands for October alone at 62,000 hryvnia or $7,750. </P>
<P>SAC and elected judiciary bodies have repeatedly informed the president, premier and Verkhovna Rada about the critical need in funding of all Ukraine’s administrative courts, the statement runs. </P>
<P>In all, there were 30 such appeals but the funding has not improved. </P>
<P>SAC won’t be able to perform its functions during the election process, reminding that it is the first and last instance court in case the voting results are contested. </P>
<P>Under the 2009 budget, UAH 1.984 billion is allocated to the funding of courts, down by 19% on 2008. </P Print

    • The election will not even be close. there is no contest. Only two candidates will progress to the second round ballot. All the opinion pols show that the choice will be between Yanukovych and Tymoshenko. Yatsenyuk, third placed candidate is 10 percentage points behind Yulia Tymochenko and all other cadnidates including Yushchenko are even further away. An election can only be disputed if any errors or omission can be demonstrated to have altered the outcome of the election. It is not sufficent to say that a minor error of proceedure or matter related to a minor candidate can null in void the whole election. It was disputable that then errors identified in 2004 would have altered the results. Statistics shows that there is always a 4 to 6 % swing towards the opposition in any rerun ballot. Unlike the 2004 ballot the 2010 election will not be a close race. In fact the whole election itself is a joke and a total waste of limited resources. At a cost of over 100 million dollars. Money that could have helped pay off Ukraine’s debt or improve Ukraine’s infrastructure. The head of state should have been elected by a constitutional majority of Ukraine’s democratically elected representative parliament. Cost $0.00 Moldova, Greece and the EU all elect their head of state by a parliamentary majority. Canada, Australia and new Zealand’s parliament also appoint their head of state. Even the US president is not directly elected but instead is appointed by an undemocratic unrepresentative electoral college. The current election is just a circus parade of clowns designed to promote the big event which will follow. The only good that will come from it is that Yushenko will b e ousted from office.
