Danapro Co. decries backroom dealings by Lviv Mayor Sadovyj

“Lviv city council Feb. 23 press release describing the attitude of Implenia Global Solutions with regard to the tender to select an investor for the stadium construction in Lviv reflects backstage dealings by the mayor and his entourage,” says the official statement by Danapro Co. released Feb. 25 to ZIK and signed by Danapro director Rostyslav Shtyn.

In particular, the statement runs: ”The Danapro Co. is directly linked to the tender to select an investor and a construction company to build a stadium and adjacent infrastructure for the Euro-20-12 tournament in Lviv. To support this and in order to dismiss the Lviv city council press service report, we bring to your notice the following information.

On Nov. 1, 2006, Danapro general manager Rostyslav Shtyn received a letter signed by Mayor Sadovyj requesting him to find investors to build a stadium for Euro-2012 in Lviv” (the copy of the letter is attached).

On May 7, 2007 Danapro and Axon Projektentwicklungs Gmbh & Co. KG signed an agreement on cooperation in the Lviv-Euro 2012 project.

On Aug. 2, 2007 Danapro and Implenia Global Solutions signed a memorandum in Austria on building a stadium and infrastructure in Lviv. In keeping with the memorandum, Danapro was to fund the architectural concept of the stadium and infrastructure, while Implenia had to draw up the project’s design and presentation. Besides, Implenia confirmed its readiness to search for investors for the project (the copy of the memorandum is attached).

On Aug. 16, 2007, Danapro and Lviv city council signed an agreement on confidentiality regarding the Euro-2012 project.

On Sept. 2007, Axon and Implenia signed a contract to set up a community of contenders to take part in a tender to select an investor for the stadium and infrastructure construction in which Axon represented an investment fund.

In the period of cooperation between Implenia, Axon and Danapro, several presentations were held, with Axon and Implenia joining forced to participate in a tender to select an investor for stadium construction.

On Feb. 6, 2008, however, Lviv city council went public on its website to announce the winner of the tender, Alpina Bau GmbH.

On Feb. 11, 2008, Danapro, authorized by Axon and in defense of its interests and partners, protested to the prosecution the activities of the tender commission, accusing the commission of backroom dealings and failure to release truthful information to tender participants and saying it possesses evidence of this. “We have resorted to such practices for the sake of fair and transparent organization of the Euro 2012 tournament in Lviv. Our protest must be a warning to the organizers who are committed to act in keeping with European standards,” the Danapro statement runs.

“Implenia – Axon/Danapro consortium was the only tender participant which met all the requirements related to design, investment and construction parameters imposed by the tender.

“Now regarding the Implenia statement that participation in the tender brought it a lot of satisfaction. Such a statement is logical and understandable as the main financial pressure, risks and the burden of organization were on the Danapro Co. and its partners. It is pitiable that the Swiss company should be misled by the unfair practices of the city mayor and his entourage and became hostage to their backroom dealings,” the Danapro statement continues.

“As regards Danapro, we were not pleased by the standard of our cooperation with the Lviv city council and Mayor Sadovyj and therefore reserve the right to receive questions to our answers from the prosecution. Our questions, notably, are: What were the tender terms and who had finally become the winner?” runs the Danapro statement.
